General Terms and Conditions of ISC Vertriebs GmbH with customer information

The following terms and conditions also contain legal information on your rights under the provisions on contracts in distance selling and electronic commerce.

§1 Scope:

Applicability to entrepreneurs and definitions of terms

(1) The following general terms and conditions apply to all deliveries between us (the company ISC Vertriebs GmbH, Moenichhusen 77, 32549 Bad Oeynhausen hereinafter also referred to as "seller") and a consumer (hereinafter also referred to as “customer”) in the version valid at the time of the order. The terms and conditions apply to all purchases made by a consumer in the ISC online shop.

Consumer in this sense is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity can be attributed (§ 13 BGB). 

(2) Deviating conditions of the consumer are not recognized unless we expressly agree to their validity.

(3) The presentation of the goods in our online shop does not represent a legally binding contract offer on our part, but is only a non-binding invitation to the consumer to order goods. The sole presentation of the goods offers the opportunity to place an order. This is not yet a binding offer on our part. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.

Service descriptions in catalogs and on the websites do not have the character of an assurance or guarantee.

All offers are valid “while stocks last”, unless otherwise stated on the products. Apart from that, errors remain reserved.

The offer is accepted in writing or in text form or by sending the ordered goods.

(4) When an order is received in our online shop, the following regulations apply: The consumer submits a binding contract offer by completing the ordering procedure provided in our online shop passed successfully. We confirm receipt of your order and your payment by sending you an order confirmation with details to the e-mail address you have provided.


The order is made in the following steps:

The consumer can return to the website before submitting the binding order by pressing the "Back" button in the Internet browser he is using after checking his information , on which the customer's details are recorded and input errors are corrected or the ordering process is canceled by closing the Internet browser. We confirm the receipt of the order immediately by an automatically generated e-mail (confirmation of receipt). This does not constitute acceptance of the offer. The automatic acknowledgment of receipt merely documents that we have received your order. The offer is accepted in writing, in text form or by sending the ordered goods within Germany within 2-5 working days. The purchase contract is only concluded when we ship the ordered product to the consumer within 2-5 days, hand it over or the shipment to the consumer within 2-5 days with a second e-mail, express order confirmation or sending of the invoice. 


(5) Storage of the text of the contract for orders via our online shop: We save the text of the contract and send it to the e-mail address you specified along with our general terms and conditions. You can also view the general terms and conditions at any time at https://www.isc-kosmetik.de/es/policies/terms-of-service If you have registered in our shop, you can view your past orders in your customer profile under My Account -> My Orders.
In addition, we save the text of the contract and make it however not accessible on the internet.

(6) Deviating conditions of the customer are not recognized unless the seller expressly agrees to their validity.


§3 Prices, shipping costs, payment, due date

(1) The prices given are final prices. The prices stated on the product pages include statutory sales tax and other price components. The amount that is shown at the time of the binding order applies. We assume the shipping costs for goods deliveries within the European Union for the consumer. There are no additional taxes and costs for shipments within the European Union. We calculate any shipping costs for goods deliveries outside the European Union (e.g. to England and Switzerland) and for worldwide shipping according to the costs of the delivery or delivery service. Shipping costs will be clearly communicated to consumers residing in Great Britain, Switzerland and countries outside the European Union as part of the ordering process. The consumer assumes any taxes incurred in non-EU countries.

(2) The consumer has the option of paying by direct debit, PayPal, credit card (Visa Card, Master Card, American Express), Apple Pay, Google Pay or Shop Pay . The consumer can choose from the available payment methods before completing the ordering process. Consumers will be aware of the available payment media informed on a separate information page. Payment by invoice is not possible. Payment must be made in advance without deduction.

(3)  If third-party providers are commissioned to process payments, e.g. Paypal, their general terms and conditions apply.


§4 Delivery, availability of goods

(1) Unless we have clearly stated otherwise in the product description, all of the items we offer are ready for dispatch immediately. The delivery takes place within 2-5 working days within Germany at the latest. We ask for your understanding if there are delays due to an increased volume of orders. The period begins to run on the day after the conclusion of the contract. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.


(2) The risk of accidental loss and accidental deterioration of the item sold is also transferred to the customer in the case of mail-order sales from the time of shipment to the customer.   

(3) If not all ordered products are in stock, the seller is entitled to make partial deliveries at his own expense, provided this is reasonable for the customer.

(4) If the delivery of the goods fails through the fault of the customer despite three delivery attempts, the seller can withdraw from the contract. Payments made will be refunded to the customer immediately.

(5) If the ordered product is not available because the seller is not supplied with this product by his supplier through no fault of his own, the seller can withdraw from the contract. In this case, the seller will inform the customer immediately and, if necessary, propose the delivery of a comparable product. If no comparable product is available or the customer does not want a comparable product to be delivered, the seller will immediately reimburse the customer for any consideration already paid.

(6) Consumers are informed about delivery times and delivery restrictions (e.g. restrictions on deliveries to certain countries) on a separate information page or within the respective product description.


§5 Retention of title

We reserve title to the goods until the purchase price has been paid in full and the goods have been shipped.

We stand behind the quality of our products and want you, the consumer, to be 100 percent satisfied. If for any reason you are not satisfied with your purchase, a refund will be given after you have returned the goods to the account of the payment method used for payment Please comply with the following guidelines.
Items must be returned within 14 days of ordering. To help us process your return, please include a note with your order number, name, email address and the reason for returning the item or items.

(1) Consumers have a right of withdrawal according to the following proviso, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither their commercial nor their self-employed professional activity:

The cancellation period is fourteen days, from the Day on which you or a third party named by you who is not the carrier took possession of the goods.

by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. You can use the attached sample revocation form, which is not mandatory. 

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Revocation consequences 

If you withdraw from this contract, we will owe you all payments that we have received from you, including delivery costs (except for the additional costs resulting therefrom that you have chosen a different type of delivery than the cheapest standard delivery offered by us) immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged for this repayment. 

We can refuse the repayment until we have received the goods back or until you have provided proof that you have sent back the goods, depending on whichever is the earlier point in time.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send the goods back before the period of fourteen days has expired. 

You bear the direct costs of returning the goods.


You only have to pay for any loss in value of the goods if this loss in value is due to the handling of the goods that is not necessary to establish the nature, properties and functioning of the goods .

§9 Warranty and Guarantee

(1) The statutory warranty regulations apply.

(2) The goods delivered by the seller are only guaranteed if this has been expressly given. Customers will be informed of the warranty conditions prior to initiating the ordering process.


§10 Liability

(1) The following exclusions and limitations of liability apply to the seller's liability for damages, notwithstanding other statutory claims.
(2) The seller is liable without limitation if the cause of the damage is based on intent or gross negligence.
(3) Furthermore, the seller is liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which is proper execution of the contract in the first place and on compliance with which the customer regularly relies. In this case, however, the seller is only liable for the foreseeable, contract-typical damage. The seller is not liable for slightly negligent violations other than those mentioned in the previous sentences mentioned obligations.
(4) The above limitations of liability do not apply in the event of injury to life, body and health, for a defect after the assumption of a guarantee for the quality of the product and for fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
(5) Insofar as the seller's liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.


§11 Contract language, applicable law, place of jurisdiction

(1) German is the only contractual language available.

(2) The place of jurisdiction and performance is the seller's registered office if the customer is a merchant, a legal entity under public law or a special fund under public law.


§12 Dispute Resolution

The EU Commission has created an internet platform for the online settlement of disputes. The platform serves as a point of contact for the out-of-court settlement of disputes relating to contractual obligations arising from online sales contracts. More information is available at the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in a dispute settlement procedure before a consumer arbitration board.


§13 data protection

(1) The seller processes the customer's personal data for a specific purpose and in accordance with the statutory provisions.

(2) The personal data provided for the purpose of ordering goods (such as name, e-mail address, address, payment data) are used by the seller to Fulfillment and processing of the contract used. This data will be treated confidentially. And not passed on to third parties who are not involved in the ordering, delivery and payment process.

(3) The customer has the right to request information free of charge about the personal data that the seller has stored about him.In addition, he has the right to correct incorrect data, blocking and deletion of his personal data unless there is a legal obligation to retain it.
